Disability Discrimination: The Basics
Not only does the Americans with Disabilities Act (ADA) provide disabled workers with employment protections, but both New York state and New York City have disability laws on the books as well. Specifically, these laws prohibit employers from wrongfully terminating or discriminating against employees because of a disability or a perceived disability, including during the application and hiring process.
In addition, employers must make reasonable accommodations for a disability, meaning that if your employer can change something about your job or the way that you do your job so that you can continue to perform your job functions with your disability, then it is required to do so, but only if the accommodation is reasonable. Reasonable accommodations may include:
- Making the workplace or facilities disability-accessible
- Restructuring your job or job functions to accommodate your disability
- Modifying your work schedule
- Providing you with modified work equipment so you can complete job functions
- Providing qualified readers, interpreters or screen reader software
If you employer refuses to make reasonable accommodations ― or wrongfully fires you because of your disability ― you may be able to seek damages for any lost wages, physical damages and emotional distress, depending on the circumstances.
If you believe your employer has committed an ADA violation or a violation of New York state or NYC law, you need to contact an experienced lawyer as soon as possible ― you need to contact The Rose Law Group PLLC.
